The British Parliament features greater <a href=\"https:\/\/www.conservativehome.com\/platform\/2013\/05\/philip-cowley-and-mark-stuart-for-1000am-tuesday.html\"><span class=\"s2\">backbench independence<\/span><\/a>, more insightful committees, and a revamped <a href=\"https:\/\/ukcatalogue.oup.com\/product\/9780199671564.do\"><span class=\"s2\">upper house<\/span><\/a>. When it comes to reforming the power to dissolve Parliament and how governments hold the confidence of the lower house, however, the United Kingdom is arguably a cautionary tale. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">In 2011, the British Parliament passed the <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2011\/14\/contents\/enacted\"><span class=\"s2\">Fixed-term Parliaments Act<\/span><\/a> (FTPA). The FTPA <a href=\"https:\/\/pa.oxfordjournals.org\/content\/early\/2015\/03\/29\/pa.gsv003.full.pdf+html\"><span class=\"s2\">curtailed<\/span><\/a> the Prime Minister&#8217;s authority to call an election when she or he pleased, using the Crown&#8217;s prerogative. Under the FTPA, Parliament will be dissolved for a general election at a set date every five years. Early elections can only occur if two-thirds of MPs agree to hold one, or if a majority of MPs explicitly withdraws confidence in the government and the Commons cannot explicitly express confidence in a government within fourteen days. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">On the surface, the legislation seems fairly straight-forward. Yet it&#8217;s caused so much <a href=\"https:\/\/lordsoftheblog.net\/2015\/03\/07\/triggering-an-early-election\/\"><span class=\"s2\">confusion<\/span><\/a> that one has to wonder if British parliamentarians understood what they voted for. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">It&#8217;s <a href=\"https:\/\/ukconstitutionallaw.org\/2014\/11\/19\/alexander-horne-and-richard-kelly-prerogative-powers-and-the-fixed-term-parliaments-act\/\"><span class=\"s2\">unclear<\/span><\/a>, for instance, whether the FTPA has completely abolished the Crown&#8217;s prerogative to dissolve Parliament or if the prerogative has merely been put into abeyance. While the legislation ensures that the <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2011\/14\/schedule\/enacted\"><span class=\"s2\">Crown&#8217;s prerogative<\/span><\/a> can no longer be used to dissolve Parliament, it is unknown if that power can spring back to life if the FTPA is repealed or amended, as some British MPs are <a href=\"https:\/\/services.parliament.uk\/bills\/2014-15\/fixedtermparliamentsrepeal.html\"><span class=\"s2\">seeking<\/span><\/a>. Things would be much simpler if the prerogative is merely in abeyance and Parliament decides to ditch the FTPA, but the law may have amended the British constitution in a more significant way than is realized.\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">More problematically, the FTPA has sowed confusion about how and when a government loses confidence. On the one hand, <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2011\/14\/section\/2\/enacted\"><span class=\"s2\">the law<\/span><\/a> suggests that governments have only lost confidence if a motion stating &#8220;That this House has no confidence in Her Majesty&#8217;s Government&#8221; is passed. On the other hand, the United Kingdom&#8217;s <a href=\"https:\/\/www.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/60641\/cabinet-manual.pdf\"><span class=\"s2\">Cabinet Manual<\/span><\/a> states that the &#8220;Prime Minister is expected to resign where it is clear that he or she does not have the confidence of the House of Commons and that an alternative government does have the confidence.&#8221; This suggests that losses of confidence are still <a href=\"https:\/\/publiclawforeveryone.com\/2015\/04\/28\/the-fixed-term-parliaments-act-a-reply-to-colin-talbot\/\"><span class=\"s2\">governed by convention<\/span><\/a>, and that the provisions outlined in the FTPA only apply to losses of confidence that allow for an early election. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Disagreement about how confidence is lost (or not) has sparked <a href=\"https:\/\/policyoptions.irpp.org\/2015\/04\/26\/fixed-term-parliaments-ten-observations-from-across-the-pond\/\"><span class=\"s2\">debate<\/span><\/a> about whether governments will be able to remain in power even if they cannot get budgets through, get positive votes on the Queen&#8217;s Speech or pass significant legislation. In turn, this raises <a href=\"https:\/\/colinrtalbot.wordpress.com\/2015\/04\/26\/who-governs-britain-after-may-7th\/\"><span class=\"s2\">concerns<\/span><\/a> that governments will either be able to keep power when they shouldn&#8217;t, or that they can be held hostage by the opposition, being denied the ability to pursue their legislative agenda, hold an early election, or perhaps most strangely, being forced to resign, then being asked to form the government again because no other party can, yet still face a House that blocks their ability to pass budgets and laws.\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Of course, this is quite far fetched and unlikely to happen. The parties in the House will surely find a way to pass budgets and laws, and they&#8217;ll avoid situations where governments hold confidence but are blocked from getting their major initiatives through. But the very fact that FTPA is raising these questions and possibilities highlights that the statute is confusing, was not been properly explained, and may stir trouble as parties exploit the confusion to their own ends. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Whatever the benefits of the FTPA (which are critiqued <a href=\"https:\/\/www.telegraph.co.uk\/news\/general-election-2015\/11320637\/This-Act-of-folly-has-condemned-us-to-five-years-of-political-torment.html\"><span class=\"s2\">here<\/span><\/a> and which I&#8217;ll cast doubt on in a future post), it&#8217;s an example of why reforms shouldn&#8217;t be rushed or be unnecessarily convoluted.<span class=\"Apple-converted-space\">\u00a0 \u00a0 \u00a0<\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Advocates of parliamentary reform in Canada often look to the United Kingdom for inspiration.
