{"id":291524,"date":"2015-02-23T23:35:51","date_gmt":"2015-02-24T04:35:51","guid":{"rendered":"https:\/\/policyoptions.irpp.org\/2015\/02\/the-judicial-activism-debate-continued\/"},"modified":"2025-08-28T15:17:59","modified_gmt":"2025-08-28T19:17:59","slug":"the-judicial-activism-debate-continued","status":"publish","type":"post","link":"https:\/\/policyoptions.irpp.org\/fr\/2015\/02\/the-judicial-activism-debate-continued\/","title":{"rendered":"The judicial activism debate (Continued)"},"content":{"rendered":"<p>Emmett Macfarlane has <a href=\"https:\/\/www.macleans.ca\/politics\/what-were-talking-about-when-we-talk-about-judicial-activism\/\" target=\"_blank\">a post over at Maclean&#8217;s<\/a>, &#8220;elaborating on what judicial activism means and why it can be a useful concept&#8221; (according to his own summary <a href=\"https:\/\/policyoptions.irpp.org\/2015\/02\/23\/the-judicial-activism-debate\/\" target=\"_blank\">here<\/a>). It is, in part, a response to the arguments I made <a href=\"https:\/\/policyoptions.irpp.org\/2015\/02\/20\/how-not-to-criticize-the-supreme-court\/\" target=\"_blank\">here<\/a>\u00a0and at my own blog. As <a href=\"https:\/\/doubleaspectblog.wordpress.com\/2015\/02\/23\/leaving-a-dragon-out\/\" target=\"_blank\">I explain in greater detail over at my own blog<\/a>, I&#8217;m afraid I&#8217;m still not persuaded by prof. Macfarlane&#8217;s claim that the phrase &#8220;judicial activism&#8221; can be useful \u201d\u2022 that is to say, I am not persuaded that it says something that could not be said in\u00a0more precise and less confusing terms.<\/p>\n<p>However, my disagreement with prof. Macfarlane is\u00a0limited this issue of semantics.\u00a0He is right that we can and should be talking about the choices which the Supreme Court (and other courts) make in the process of deciding constitutional cases, and we should also be talking about the ways in which ideology, if not partisan politics, influences these choices.<\/p>\n<p>These debates are indeed important. It is all good and well to say that it is our elected officials who foisted the <em>Canadian Charter of Rights and Freedoms<\/em> and other constitutional laws upon the country, and that in striking down legislation which these officials&#8217; successors enact the courts are only doing their bidding, but the way in which they discharge this duty should be no less open to criticism than the way in which legislators and civil servants discharge theirs.
