But given that most of the goods we consume are produced through international supply chains<\/span><span data-contrast=\"auto\">, it\u2019s hard to avoid. We often do not know how these goods are made and how the people making them were treated.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Brands at the top of the chain enter into contracts with a myriad of contractors and suppliers located in countries where labour standards are low, weakly enforced or both. Little wonder there are repeated reports about <\/span><a href=\"https:\/\/aboveground.ngo\/wp-content\/uploads\/2021\/06\/Above-Ground-forced-labour-report-June-2021.pdf\"><span data-contrast=\"none\">forced labour<\/span><\/a><span data-contrast=\"auto\"> making it into cocoa from C<\/span><span data-contrast=\"none\">\u00f4<\/span><span data-contrast=\"auto\">te d\u2019Ivoire and Ghana, palm oil from Indonesia, medical gloves from Malaysia and consumer goods that come from the Xinjiang region of China where the Uyghurs are repressed.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The Liberal government has <\/span><a href=\"https:\/\/www.theglobeandmail.com\/politics\/article-liberal-government-throws-support-behind-private-bill-aimed-at\/\"><span data-contrast=\"none\">thrown its support<\/span><\/a><span data-contrast=\"auto\"> behind Senate Bill S-211, the <\/span><a href=\"https:\/\/www.parl.ca\/legisinfo\/en\/bill\/44-1\/s-211\"><i><span data-contrast=\"none\">Fighting Against Forced Labour and Child Labour in Supply Chains Act<\/span><\/i><\/a><span data-contrast=\"auto\">. It is one of <\/span><a href=\"https:\/\/gflc.ca\/wp-content\/uploads\/2020\/10\/GFLC-Brief-Canadian-Modern-Slavery-and-Due-Diligence-Laws-28-June-2022-.pdf\"><span data-contrast=\"none\">four similar bills<\/span><\/a><span data-contrast=\"auto\"> before Parliament but it is <\/span><a href=\"https:\/\/www.ourcommons.ca\/DocumentViewer\/en\/44-1\/house\/sitting-74\/hansard#11699320\"><span data-contrast=\"none\">as some suggest<\/span><\/a><span data-contrast=\"auto\"> a modest proposal. The bill should be strengthened if it is to have any hope of success.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The legislation would force large Canadian companies to disclose any efforts taken to identify, eradiate or mitigate forced labour in their businesses and supply chains.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">It is modelled after the U.K. <\/span><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2015\/30\/contents\/enacted\"><i><span data-contrast=\"none\">Modern Slavery Ac<\/span><\/i><span data-contrast=\"none\">t<\/span><\/a><span data-contrast=\"auto\">. The idea behind S-211 and its U.K. model is to shine a light on corporate practices so consumers and investors can punish those companies that do not do enough to combat child and forced labour. <\/span><a href=\"https:\/\/www.ourcommons.ca\/DocumentViewer\/en\/44-1\/house\/sitting-74\/hansard#11699320\"><span data-contrast=\"none\">Supporters of Bill S-211<\/span><\/a><span data-contrast=\"auto\"> acknowledge that it is only a first step. It does not require companies to do anything to detect, eliminate or mitigate forced or child labour \u2013 but only to identify areas where they might exist.<\/span><\/p>\n<p><span data-contrast=\"auto\">By contrast, Canada\u2019s <\/span><a href=\"https:\/\/gflc.ca\/wp-content\/uploads\/2020\/10\/GFLC-Brief-Canadian-Modern-Slavery-and-Due-Diligence-Laws-28-June-2022-.pdf\"><span data-contrast=\"none\">most recent legislative proposal<\/span><\/a><span data-contrast=\"auto\">, a private members bill (<\/span><a href=\"https:\/\/www.parl.ca\/DocumentViewer\/en\/44-1\/bill\/C-262\/first-reading\"><span data-contrast=\"none\">Bill C-262<\/span><\/a><span data-contrast=\"auto\">), would<\/span> <span data-contrast=\"auto\">take the next step. It would require companies to take care to prevent forced and child labour in their businesses and supply chains, and to mitigate any risks of it occurring.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">This proposal is modeled after mandatory human rights due-diligence laws that have been adopted in France, Germany, Switzerland and Norway. The forthcoming European Union directive on <\/span><a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_22_1145\"><span data-contrast=\"none\">corporate sustainability due diligence<\/span><\/a><span data-contrast=\"auto\"> is also expected to follow this model. It would require companies doing business in the world\u2019s largest single market to do something to prevent forced and child labour.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Despite <\/span><a href=\"https:\/\/www.ourcommons.ca\/DocumentViewer\/en\/42-1\/FAAE\/report-19\"><span data-contrast=\"none\">parliamentary committee reports<\/span><\/a><span data-contrast=\"auto\">, <\/span><a href=\"https:\/\/www.canada.ca\/content\/dam\/esdc-edsc\/documents\/programs\/international-affairs\/reports\/what-we-heard-forced-labour-global-supply-chain\/Forced_Labour_WWHR(EN)-v2.pdf\"><span data-contrast=\"none\">government consultations<\/span><\/a><span data-contrast=\"auto\"> and <\/span><a href=\"https:\/\/gflc.ca\/wp-content\/uploads\/2020\/10\/GFLC-Brief-Canadian-Modern-Slavery-and-Due-Diligence-Laws-28-June-2022-.pdf\"><span data-contrast=\"none\">the initiatives of other comparable countries<\/span><\/a><span data-contrast=\"auto\">, Canada has been slow on the uptake. The Liberal government has not introduced even modest legislation imposing reporting obligations on Canadian businesses. This is perhaps why the modern slavery act supporters have described it as a first step. They know how weak the bill is compared to what is needed.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Without significant amendments, it isn\u2019t going to address the problem of forced and child labour in supply chains.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">There is a growing awareness that the use of disclosure legislation has not produced tangible results. First, reporting has <\/span><a href=\"https:\/\/media.business-humanrights.org\/media\/documents\/Modern_Slavery_Act_2021.pdf\"><span data-contrast=\"none\">tended to be superficial<\/span><\/a><span data-contrast=\"auto\">. Second, the requirements do not reach the segment of supply chains where the worst human rights abuses occur. Third, corporations can comply with legislation <\/span><a href=\"https:\/\/static1.squarespace.com\/static\/6055c0601c885456ba8c962a\/t\/61d71e46967f033bb694f6e5\/1641487943126\/ReStructureLab_DueDiligence_April2021_AW.pdf\"><span data-contrast=\"none\">without changing corporate practices<\/span><\/a><span data-contrast=\"auto\"> that are clearly tied to human rights abuses. Further, there is no evidence that disclosure laws can be used as a stepping stone towards more robust due-diligence legislation. None of the jurisdictions that have made the first step have taken a second.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">At best, disclosure laws raise awareness of the problem. At worst, they are a form of window dressing in which reporting substitutes for remedial action.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<blockquote><p><strong><a href=\"https:\/\/policyoptions.irpp.org\/magazines\/december-2018\/canadas-contribution-ending-slavery\/\">Canada\u2019s contribution to ending slavery<\/a>\u00a0<\/strong><\/p>\n<p><strong><a Canada<\/a>\u00a0<\/strong><\/p><\/blockquote>\n<p><span data-contrast=\"auto\">The time is now to press Labour Minister Seamus O\u2019Regan on his government\u2019s commitment <\/span><a href=\"https:\/\/www.theglobeandmail.com\/politics\/article-liberal-government-throws-support-behind-private-bill-aimed-at\/\"><span data-contrast=\"none\">to strengthen Bill S-211<\/span><span data-contrast=\"none\">.<\/span><\/a><span data-contrast=\"auto\"> In fact, the government has a clear model on the table (Bill C-262) as a good example of mandatory due-diligence legislation.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">To have any real chance of tackling child and forced labour in supply chains, the<\/span><a href=\"https:\/\/gflc.ca\/wp-content\/uploads\/2020\/10\/GFLC-submission-to-Employment-and-Social-Development-Canada-Consultation-on-Labour-Exploitation-in-Supply-Chains.pdf\"><span data-contrast=\"none\"> Canadian law must<\/span><\/a><span data-contrast=\"auto\">:<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<ul>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"1\"
