Mais en r\u00e9alit\u00e9, toutes sortes de situations m\u00e8nent encore des d\u00e9tenus en isolement, m\u00eame si la pratique contrevient \u00e0 <\/span><a href=\"https:\/\/www.cbc.ca\/radio\/asithappens\/as-it-happens-thursday-edition-1.5927937\/canada-promised-to-end-solitary-confinement-but-a-new-report-says-it-s-still-happening-1.5927940\"><span data-contrast=\"none\">la Charte canadienne des droits et libert\u00e9s<\/span><\/a><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Les <\/span><a href=\"https:\/\/www.csc-scc.gc.ca\/acts-and-regulations\/005006-3000-fr.shtml\"><span data-contrast=\"none\">unit\u00e9s d&#8217;intervention structur\u00e9es<\/span><\/a><span data-contrast=\"auto\"> (UIS) ont \u00e9t\u00e9 mises en place il y a un peu plus de deux ans par Service correctionnel Canada (SCC) pour remplacer l\u2019isolement, un r\u00e9gime de s\u00e9gr\u00e9gation administrative jug\u00e9e inconstitutionnel. Le <\/span><a href=\"https:\/\/www.canada.ca\/fr\/securite-publique-canada\/nouvelles\/2019\/06\/adoption-parlementaire-du-projet-de-loic-83-transformer-le-systeme-correctionnel-afin-de-mettre-laccent-sur-la-reinsertion-sociale-et-les-soins-de-.html\"><span data-contrast=\"none\">minist\u00e8re de la S\u00e9curit\u00e9 publique laissait entendre<\/span><\/a><span data-contrast=\"auto\"> que les UIS offraient une mani\u00e8re plus humaine de s\u00e9parer certains individus du reste de la population carc\u00e9rale. Plus de temps hors de la cellule est maintenant pr\u00e9vu, tout comme l&#8217;occasion d&#8217;avoir un \u00ab\u202fcontact humain significatif\u202f\u00bb. Ces changements devaient faire partie d&#8217;une <\/span><a href=\"https:\/\/www.canada.ca\/fr\/service-correctionnel\/nouvelles\/2020\/10\/le-service-correctionnel-du-canada-aborde-la-question-des-unites-dintervention-structuree.html\"><span data-contrast=\"none\">\u00ab\u202ftransformation historique\u202fdu syst\u00e8me correctionnel f\u00e9d\u00e9ral\u202f\u00bb<\/span><\/a><span data-contrast=\"auto\"> et avaient \u00e9t\u00e9 largement applaudis par la population.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">En v\u00e9rit\u00e9, il n&#8217;y aucune fa\u00e7on humaine de maintenir quelqu&#8217;un en isolement. Quelle que soit sa forme (UIS, \u00e9valuation de la sant\u00e9 mentale, confinement, cellule s\u00e8che) toutes ces mesures sont caract\u00e9ris\u00e9es par une scrutation constante, un isolement accru et de graves cons\u00e9quences sur la sant\u00e9 mentale. Les pratiques en mati\u00e8re de s\u00e9curit\u00e9 doivent \u00eatre modifi\u00e9es de telle sorte que SCC (et le gouvernement) traite les prisonniers pour ce qu&#8217;ils sont : des \u00eatres humains. Il ne faut pas se demander quelles options existent pour remplacer l&#8217;isolement \u2013 elles sont connues \u2013, mais plut\u00f4t pourquoi SCC ne les utilise pas\u202f?<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">En novembre 2021, un <\/span><a href=\"https:\/\/lactualite.com\/actualites\/un-tribunal-de-la-nouvelle-ecosse-juge-que-la-cellule-seche-est-inconstitutionnelle\/\"><span data-contrast=\"none\">juge de la cour supr\u00eame de Nouvelle-\u00c9cosse<\/span><\/a><span data-contrast=\"auto\"> a jug\u00e9 inconstitutionnelle une autre forme d&#8217;isolement : la cellule s\u00e8che.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">La cellule s\u00e8che est une pratique cruelle qui consiste \u00e0 garder une personne soup\u00e7onn\u00e9e de contrebande dans une cellule o\u00f9 on l&#8217;observe constamment, sous des lumi\u00e8res allum\u00e9es 24 heures par jour, sans acc\u00e8s \u00e0 l&#8217;eau courante ni \u00e0 des contacts humains (et donc \u00e0 des conseils juridiques). Pour les personnes soup\u00e7onn\u00e9es de dissimuler quelque chose dans leur vagin, la loi ne pose pas de limites au temps de confinement, et les objets peuvent mettre \u00e9norm\u00e9ment de temps \u00e0 \u00eatre expuls\u00e9s, quand ils le sont. La demanderesse devant la cour supr\u00eame n\u00e9o-\u00e9cossaise, Lisa Adams, avait \u00e9t\u00e9 isol\u00e9e dans de telles conditions durant 16 jours.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Le juge John Keith a <\/span><a href=\"https:\/\/www.canlii.org\/en\/ns\/nssc\/doc\/2021\/2021nssc313\/2021nssc313.html?searchUrlHash=AAAAAQAJZHJ5IGNlbGwgAAAAAAE&amp;resultIndex=2\"><span data-contrast=\"none\">invalid\u00e9 l\u2019article<\/span><\/a><span data-contrast=\"none\"> 51<\/span><span data-contrast=\"auto\">\u00a0<\/span> <span data-contrast=\"auto\">de la <\/span><a href=\"https:\/\/www.canlii.org\/en\/ca\/laws\/stat\/sc-1992-c-20\/latest\/sc-1992-c-20.html#sec51_smooth\"><span data-contrast=\"none\">Loi sur le syst\u00e8me correctionnel et la mise en libert\u00e9 sous condition<\/span><\/a><span data-contrast=\"auto\"> portant sur la cellule s\u00e8che, puisqu&#8217;il contrevient \u00e0 l&#8217;article 15 de la Charte. Il a fait remarquer que les personnes soup\u00e7onn\u00e9es de dissimuler quelque chose dans leur vagin subissent un pr\u00e9judice exag\u00e9r\u00e9, tant en raison de la cellule s\u00e8che elle-m\u00eame que du temps qu\u2019elles y passent. Le juge Keith a estim\u00e9 <\/span><span data-contrast=\"auto\">que les dommages sont \u00ab\u202fdistincts\u202f\u00bb et \u00ab\u202fsignificatifs\u202f\u00bb.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Ce jugement est une importante victoire pour les d\u00e9tenus, mais cette victoire doit conduire \u00e0 des changements d\u2019une plus grande ampleur.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Les cellules s\u00e8ches (et \u00e0 vrai dire toute forme d&#8217;isolement) sont des punitions extraordinaires, cruelles et en opposition aux droits \u00e0 la vie, la libert\u00e9 et la s\u00e9curit\u00e9. Il s&#8217;agit d&#8217;une violation de la Charte.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Comme le montrent les rapports publi\u00e9s par <\/span><a href=\"https:\/\/johnhoward.ca\/drs-doob-sprott-report\/\"><span data-contrast=\"none\">Jane Sprott, Anthony Doob et Adelina Iftene<\/span><\/a><span data-contrast=\"auto\">, tout comme le <\/span><a href=\"https:\/\/www.oci-bec.gc.ca\/index-fra.aspx\"><span data-contrast=\"none\">Bureau de l&#8217;enqu\u00eateur correctionnel<\/span><\/a><span data-contrast=\"auto\">, ainsi que nos propres observations recueillies dans des prisons pour femmes f\u00e9d\u00e9rales, l&#8217;isolement est une forme de punition disproportionnellement utilis\u00e9e contre les personnes noires, autochtones et celles qui ont des probl\u00e8mes de sant\u00e9 mentale. Il s&#8217;agit d&#8217;une nouvelle violation de l&#8217;article 15 de la Charte.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<blockquote><p><a href=\"https:\/\/policyoptions.irpp.org\/magazines\/december-2021\/how-can-we-improve-our-criminal-justice-system\/\"><span data-contrast=\"none\">How can we improve our criminal justice system?<\/span><\/a><\/p>\n<p><a href=\"https:\/\/policyoptions.irpp.org\/magazines\/may-2018\/moving-restorative-justice-into-the-mainstream\/\"><span data-contrast=\"none\">Moving restorative justice into the mainstream<\/span><\/a><\/p><\/blockquote>\n<p><span data-ccp-props=\"{}\">\u00a0<\/span><span data-contrast=\"auto\">Le juge Keith a donn\u00e9 six mois au gouvernement f\u00e9d\u00e9ral afin qu&#8217;il change sa loi en accord avec la Charte. La <\/span><a href=\"https:\/\/www.caefs.ca\/\"><span data-contrast=\"none\">Canadian Association of Elizabeth Fry Society<\/span><\/a><span data-contrast=\"auto\"> et d&#8217;autres commentateurs ont bien fait savoir qu&#8217;il est impossible de r\u00e9former une pratique assimilable \u00e0 la torture. L&#8217;usage des cellules s\u00e8ches doit \u00eatre enti\u00e8rement aboli, chose que le gouvernement f\u00e9d\u00e9ral peut accomplir en rendant cette pratique ill\u00e9gale.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">De son c\u00f4t\u00e9, SCC soutient que l&#8217;usage des cellules s\u00e8ches et d&#8217;autres formes d&#8217;isolement sont essentiels au bon fonctionnement des prisons. Mais la <\/span><a href=\"https:\/\/laws-lois.justice.gc.ca\/fra\/lois\/c-44.6\/page-1.html\"><span data-contrast=\"none\">Loi sur le syst\u00e8me correctionnel et la mise en libert\u00e9 sous condition<\/span><\/a><span data-contrast=\"none\"> est claire : le syst\u00e8me correctionnel vise \u00e0 assurer l&#8217;ex\u00e9cution des peines \u00ab\u202fpar des mesures de garde et de surveillance s\u00e9curitaires et humaines\u202f\u00bb en prenant celles qui \u00ab\u202fsont les moins contraignantes\u202f\u00bb.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">SCC devrait se d\u00e9tourner des pratiques correctionnelles archa\u00efques pour aller vers des m\u00e9thodes de s\u00e9curit\u00e9 dynamiques. Les pratiques statiques se servent de l&#8217;architecture des \u00e9tablissements ; les pratiques actives se fondent sur les relations humaines. Les <\/span><a href=\"https:\/\/www.csc-scc.gc.ca\/acts-and-regulations\/566-cd-fr.shtml#3\"><span data-contrast=\"none\">directives de SCC<\/span><\/a><span data-contrast=\"none\"> pr\u00f4nent d\u00e9j\u00e0 des interactions positives, une communication active, la pr\u00e9sentation de mod\u00e8les positifs et une vigilance face aux probl\u00e8mes physiques ou mentaux.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Il est grand temps que le gouvernement f\u00e9d\u00e9ral agisse afin de prot\u00e9ger les droits et la dignit\u00e9 de la population carc\u00e9rale en mettant fin aux pratiques d&#8217;isolement au pays.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(Cet article a \u00e9t\u00e9 traduit de l\u2019anglais.)
